Debonda Terms & Conditions

These Terms and Conditions define the rules for using the website, the conditions of purchasing and booking services, as well as the rights and obligations of both users and the service provider. By using this website and confirming a booking, you acknowledge that you have read, understood, and fully accepted these Terms and Conditions.

General Provisions

These Terms and Conditions govern the contractual relationship between the user of services (hereinafter referred to as the “Guest” or “Customer”) and Island Essence d.o.o., Kranjčevićeva 26, 21000 Split, Croatia, OIB: 64945300604 (hereinafter referred to as the “Agency”), in relation to the use of the website debonda.com and the booking and provision of services offered by the Agency.

By accessing the website, submitting an enquiry, making a reservation or completing a payment, the Guest confirms that they have read, understood and fully accepted these Terms and Conditions.

The Agency reserves the right to amend these Terms and Conditions at any time. The version applicable to the Guest shall be the one valid at the time the reservation is confirmed.

Role of the Agency

Depending on the type of service provided, the Agency may act either as an organiser of the service or as an intermediary, arranging services on behalf of third-party providers such as guides, skippers, transport operators or other partners.

The Agency’s role is clearly defined in the service description, pre-booking communication and reservation confirmation. In all cases, the Agency acts with due professional care and cooperates exclusively with licensed and vetted service providers.

Scope of Services

The Agency offers, but is not limited to, the following services: private and group tours, road and maritime transfers, private boat rentals with skipper, concierge services, and multi-day travel packages and tailor-made itineraries.

Each service is accompanied by a detailed description, programme, duration, price and any specific conditions applicable to that service.

Enquiries, Reservations and Confirmation

Reservations may be made either as instant confirmation bookings, confirmed immediately upon payment, or as on-request bookings, subject to availability and additional confirmation.

For on-request bookings, no payment is processed until availability is confirmed and either a deposit or full payment is expressly agreed with the Guest.

A reservation is considered valid and confirmed only once both of the following conditions are met: the agreed payment, whether in full or as a deposit, has been received, and a written confirmation has been sent to the Guest via email.

Verbal communication, automated responses or enquiry acknowledgements do not constitute a confirmed reservation.

Prices and Payment

All prices are stated in EUR. The Agency is not subject to VAT and all prices are final unless explicitly stated otherwise in the service description.

Once a reservation is confirmed and paid, the agreed price remains fixed and will not be affected by subsequent changes in fuel costs, partner pricing, exchange rates or market conditions.

Unless otherwise agreed, services are paid in advance. Accepted payment methods include credit or debit cards via Stripe, bank transfer, PayPal and cash by prior arrangement.

Cancellations, Refunds and No-Show

Cancellations made up to 72 hours prior to the scheduled start time are subject to a 30 percent cancellation fee for most services and a 50 percent cancellation fee for private boat rentals.

Cancellations made within 72 hours of the service start time, as well as failure to appear at the agreed meeting point, are non-refundable.

Exact cancellation terms are clearly stated for each service during the booking process and in the reservation confirmation.

If the Agency is required to cancel a service due to adverse weather conditions, safety considerations, technical issues, insufficient number of participants or force majeure, the Guest will be offered either a full refund or an alternative date or service, subject to mutual agreement.

Schedule Changes and Delays

Changes to the scheduled date or time are possible up to 72 hours prior to the service start, subject to availability.

Delays exceeding 15 minutes from the agreed meeting time are considered a no-show and are subject to the applicable cancellation terms.

Safety, Weather Conditions and Decision Authority

Guest safety is the Agency’s highest priority. For activities dependent on weather or operational conditions, including maritime and outdoor experiences, the final decision regarding the execution of the service rests with the skipper, guide or organiser.

Such decisions are made solely in the interest of safety and must be respected by the Guest. Where possible, reasonable alternatives will be offered.

Insurance and Liability

Road and maritime transport services are provided in accordance with applicable Croatian laws and valid insurance policies in force at the time of service.

Such insurance coverage does not replace individual travel insurance, which Guests are strongly advised to arrange independently.

The Agency shall not be liable for the Guest’s health condition, personal belongings, damage resulting from failure to follow instructions, or circumstances beyond the Agency’s reasonable control.

Guest Responsibilities

Guests participate in activities at their own risk and are required to provide accurate and complete information, follow instructions given by staff and service providers, and behave responsibly and respectfully.

Any damage caused by inappropriate behaviour shall be borne by the Guest who made the reservation.

Photography and Promotional Materials

Photographs and video recordings may be taken during tours and activities for promotional purposes.

Guests may object to the use of their image at any time, prior to or during the service, free of charge and without providing justification.

For public figures and high-profile guests, full discretion and confidentiality are applied.

Gratuities

Gratuities are not included in the service price and are always voluntary. If the Guest is satisfied with the service provided, a customary guideline for exceptional service is 15 to 20 percent, entirely at the Guest’s discretion.

Complaints and Dispute Resolution

Complaints must be submitted in writing to privacy@debonda.com. The Agency will respond within 15 days of receipt.

Consumers may also access the European Union’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Croatia. The competent court for any disputes shall be the court in Split, Croatia.
